Please read these Terms of Service (“Terms”) carefully before using the MyVitalHome™ website located at myvitalhome.com and any related applications or services (collectively, the “Service”) operated by Freels I.T. Solutions LLC (“we,” “us,” or “our”).
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
1. Acceptance of Terms
By creating an account, joining our waitlist, or otherwise using the Service, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them on behalf of yourself or the entity you represent. If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
MyVitalHome™ is a home maintenance guidance platform that provides:
• Maintenance schedules and reminders for home systems and appliances.
• Seasonal home preparation checklists.
• General how-to guides and educational content for homeowners and renters.
• Appliance tracking and service history logging tools.
• Tiered cost guidance for do-it-yourself, subscription-based, and professional service options.
3. Informational Purpose Only — No Professional Advice
THE CONTENT PROVIDED THROUGH MYVITALHOME™ IS FOR GENERAL INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE.
Specifically, MyVitalHome™ content does not constitute and should not be relied upon as:
• Advice from a licensed contractor, plumber, electrician, HVAC technician, roofer, or any other licensed trade professional.
• A guarantee that following our guidance will prevent property damage, equipment failure, or safety hazards.
• Legal, financial, or insurance advice regarding your property.
• A warranty or guarantee of any kind regarding home systems, appliances, or service providers.
Always consult a qualified licensed professional before undertaking any significant home repair, maintenance, or improvement project. Individual home conditions vary and what works in one situation may not be appropriate or safe in another.
4. User Accounts
When you create an account with us, you agree to:
• Provide accurate, complete, and current information.
• Maintain the security of your password and account.
• Promptly notify us of any unauthorized use of your account at hello@myvitalhome.com.
• Accept responsibility for all activity that occurs under your account.
5. Subscription and Payment Terms
MyVitalHome™ may offer free and paid subscription tiers. For paid subscriptions:
• Billing: Subscriptions are billed on a monthly or annual basis as selected at the time of purchase.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: We offer a 7-day refund for new annual subscriptions. Monthly subscriptions are non-refundable once the billing period has begun.
• Price Changes: We reserve the right to change subscription prices with at least 30 days notice to existing subscribers.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Freels I.T. Solutions LLC. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Freels I.T. Solutions LLC.
MyVitalHome™ is a trademark of Freels I.T. Solutions LLC. Unauthorized use of our name, logo, or branding is strictly prohibited.
7. User Content
Any data you enter into the Service, including appliance information, service history, and maintenance notes (“User Content”), remains your property. By entering User Content into the Service, you grant us a limited license to store and display that content solely for the purpose of providing the Service to you. We do not claim ownership of your User Content and will not share it with third parties except as described in our Privacy Policy.
8. Prohibited Uses
You agree not to use the Service to:
• Violate any applicable laws or regulations.
• Reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission.
• Transmit any unsolicited or unauthorized advertising or promotional material.
• Attempt to gain unauthorized access to any portion of the Service or its related systems.
• Impersonate or attempt to impersonate Freels I.T. Solutions LLC, a MyVitalHome™ employee, or any other person or entity.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FREELS I.T. SOLUTIONS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
• Any property damage, personal injury, or financial loss resulting from actions taken based on information provided through the Service.
• Any indirect, incidental, special, consequential, or punitive damages.
• Any loss of data, revenue, profits, or business opportunities.
• Any damages arising from your reliance on information obtained through the Service in lieu of consulting a licensed professional.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Indemnification
You agree to indemnify, defend, and hold harmless Freels I.T. Solutions LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Minnesota.
13. Termination
We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the “Last Updated” date at the top of this page and, where appropriate, by sending an email notification to registered users. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Freels I.T. Solutions LLC regarding your use of the Service and supersede all prior agreements and understandings, whether written or oral, relating to the Service.
